Terms of Service
1. Acceptance of Terms
By accessing or using OralCat (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
If you are under 18, please review these terms with a parent or guardian before using the Service.
2. Description of Service
OralCat is a free AI-powered English speaking coach that:
- Transcribes speech from your microphone in real-time
- Sends the transcribed text to an AI service for grammar correction and speaking feedback
- Tracks your practice progress locally on your device and, if you sign in, on our servers
- Provides topic-based practice exercises including PSLE Oral preparation, job interview coaching, public speaking practice, and day-to-day conversation
3. Free Service and Donations
- OralCat is currently free to use.
- Users may make voluntary donations to support AI processing, cloud hosting, maintenance and future development.
- Donations are optional and are not required to use the Service.
- Unless required by law, donations are non-refundable.
4. User Accounts
- Signing in with Google is optional. You may use the Service without an account.
- If you sign in, you are responsible for maintaining the security of your account and for all activity under it.
- You may revoke OralCat's access to your Google account at any time via Google Account permissions.
5. User Eligibility
- The Service is available to users of all ages.
- Users under 13 require parental or guardian consent to sign in. Practice features are available without signing in, and no personal data is collected in that mode.
- By signing in, you confirm that you are at least 13 years of age or that a parent or guardian has reviewed these terms and consented on your behalf.
- By using the Service, you confirm that you have the legal capacity to accept these terms.
6. Acceptable Use
You agree to:
- Use the Service only for its intended purpose (English language practice)
- Not attempt to reverse engineer, modify, or create derivative works of the Service
- Not use the Service for any unlawful purpose
- Not upload, record, or transmit any content that is harmful, abusive, threatening, harassing, defamatory, or violates any law
- Not attempt to abuse, overload, or disrupt the Service
Violation of this section may result in immediate suspension or termination of your access without notice.
7. Intellectual Property
All rights, title, and interest in the Service belong to us. This includes, but is not limited to, the OralCat name, logos, branding, website design, educational content, prompts, scoring methodologies, feedback frameworks, documentation, software, and all other proprietary materials (collectively, the "OralCat IP").
You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. The OralCat IP may not be copied, reproduced, distributed, modified, scraped, reverse-engineered, or used in any way without our prior written permission, except as expressly permitted by these Terms or applicable law.
8. AI Accuracy Disclaimer
The grammar corrections, vocabulary suggestions, and feedback provided by the Service are generated by artificial intelligence. This feedback is intended for educational purposes only.
- AI-generated feedback may occasionally be inaccurate or incomplete.
- OralCat is designed to complement, not replace, guidance from teachers, parents or other educational resources.
- The Service is a practice tool and should not be used as the sole source of exam preparation.
- We recommend reviewing corrections with a teacher or parent.
- Users should exercise their own judgement when relying on the feedback.
- We are not responsible for any reliance on AI-generated feedback.
9. Privacy
Your use of the Service is governed by our Privacy Policy, which explains what data we collect, how we use it, and your rights. By using the Service, you acknowledge our data practices as described in the Privacy Policy.
10. Service Availability
- We may modify, suspend or discontinue features of the Service at any time.
- We will make reasonable efforts to notify users of significant changes.
11. Third-Party Services
The Service uses third-party services for AI processing (OpenAI Whisper, DeepSeek), database hosting (Supabase), authentication (Google), and payment processing (Stripe). We are not responsible for the availability, security, or practices of these third-party services. See our Privacy Policy for details.
12. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, either express or implied
- We are not liable for any damages arising from your use of the Service
- We are not responsible for any loss resulting from data stored locally on your device (e.g. if browser data is cleared, local progress data will be lost)
- We are not liable for any interruptions, delays, or errors in the Service
- We are not liable for data loss arising from the failure of third-party infrastructure, except where caused by our own negligence
- Our total aggregate liability arising out of or relating to the Service shall not exceed SGD $100, regardless of the nature of the claim or the legal theory under which it is brought. This cap applies even if we have been advised of the possibility of such damages and even if any limited remedy fails of its essential purpose
13. Security Disclaimer
We implement reasonable administrative, technical, and organisational measures to protect OralCat and user information. However, no website, network, or internet transmission can be guaranteed to be completely secure.
OralCat does not warrant that the Service, its servers, or any content made available through the Service will be free from viruses, malware, or other harmful components. You are responsible for maintaining appropriate antivirus software, browser updates, operating system updates, and general device security when accessing the Service.
To the maximum extent permitted by law, OralCat is not liable for losses arising from malicious attacks, malware, unauthorised access, denial-of-service attacks, or other security incidents beyond our reasonable control.
14. Force Majeure
OralCat shall not be liable for any delay, interruption, or failure to perform any obligation under these Terms where such delay, interruption, or failure is caused by events beyond our reasonable control, including but not limited to: natural disasters, cyberattacks, internet outages, cloud provider failures, power outages, government actions, labour disputes, pandemics, or other force majeure events. Performance shall be excused for the duration of such an event, and we will make reasonable efforts to resume performance as soon as practicable.
15. Termination
- We may suspend or terminate your access if these Terms are violated or the Service is abused.
- You may stop using the Service at any time.
- Upon termination, we may delete your account data in accordance with our Privacy Policy.
16. Indemnification
You agree to indemnify, defend, and hold harmless OralCat, its operators, and its service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service in violation of these Terms
- Your violation of any applicable law or regulation
- Any content you submit, record, or transmit through the Service that infringes the rights of any third party or violates any law
17. Data Breach Notification
In the event of a data breach that affects your personal information, we will notify affected users within a reasonable timeframe and, where required, the relevant authorities in accordance with applicable law.
18. Changes to Terms
We may update these Terms of Service from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will post the updated terms on this page with a revised "Last Updated" date.
19. Governing Law
These Terms of Service are governed by the laws of Singapore. Any disputes shall be resolved in the courts of Singapore.
